LIABILITY RELEASE, ASSUMPTION OF RISK, AND WAIVER OF CLAIMS

(For Minor Participants)

This Liability Release, Assumption of Risk, and Waiver of Claims (“Agreement”) is executed by the undersigned parent or legal guardian (“Parent/Guardian”) on behalf of the minor child listed below (“Participant”), in favor of Westerdahl Golf, LLC, doing business as Houston Golf Academy, and its related parties.

1. PROGRAM AND PARTICIPATION ACKNOWLEDGMENT

I acknowledge that my child is voluntarily participating in golf instruction, physical movement activities, games, demonstrations, camps, clinics, and related programming operated by Westerdahl Golf, LLC DBA Houston Golf Academy (“Houston Golf Academy”).
These activities may take place at multiple preschool campuses, schools, indoor facilities, outdoor areas, or other host locations, including any current or future locations where Houston Golf Academy programs are conducted.

2. ASSUMPTION OF RISK

I understand and acknowledge that participation in golf instruction and youth movement activities involves inherent risks, including but not limited to:

Being struck by golf clubs, training aids, or balls
Slips, falls, or collisions
Minor or serious physical injury
Equipment-related accidents
Injuries arising from indoor or outdoor environments

I knowingly and voluntarily assume all risks, both known and unknown, associated with my child’s participation, even if arising from the negligence of the released parties, to the fullest extent permitted by Texas law.

3. RELEASE AND WAIVER OF LIABILITY

On behalf of myself, my child, and our heirs, assigns, and representatives, I hereby release, waive, discharge, and covenant not to sue:

Westerdahl Golf, LLC DBA Houston Golf Academy
Its owners, officers, directors, members
Employees, W-2 staff, and 1099 independent contractors
Coaches, assistants, volunteers, and representatives
Partner preschools, schools, host facilities, property owners, and landlords
Any successors, assigns, or affiliated entities

from any and all claims, demands, actions, causes of action, damages, losses, or liabilities arising out of or related to my child’s participation in Houston Golf Academy programs, whether occurring on or off school property.

4. MEDICAL AUTHORIZATION

In the event of an emergency, I authorize Houston Golf Academy and its representatives to obtain emergency medical treatment for my child if I cannot be reached.

I understand that I am financially responsible for any medical care or transportation provided and that Houston Golf Academy assumes no responsibility for such costs.

5. RESPONSIBILITY FOR PARTICIPANT

I affirm that:

My child is physically capable of participating in the program
I will disclose any medical conditions, allergies, or limitations as required

I understand that Houston Golf Academy does not provide one-on-one medical supervision

6. PHOTO AND VIDEO RELEASE

I grant permission for Houston Golf Academy to photograph or record my child during program activities and to use such images or recordings for educational, promotional, or marketing purposes, including websites and social media, without compensation.

7. ELECTRONIC SIGNATURE CONSENT

I understand that this Agreement is being executed electronically via JotForm and agree that my electronic signature is legally binding and equivalent to a handwritten signature.

8. GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Texas, and any legal action shall be brought exclusively in a court of competent jurisdiction within Texas.

9. ACKNOWLEDGMENT AND UNDERSTANDING

I acknowledge that:

I have read this Agreement in its entirety
I fully understand its terms
I am voluntarily giving up substantial legal rights on behalf of myself and my child
